In a major development, the central cabinet has approved including of a provision to grant bail to men found guilty of giving instant triple talaq to their wives.
The government sources informed that while the offence continues to remain non-bailable, the latest provision makes it permissible for a magistrate to grant bail to the accused.
It need be mentioned that the triple talaq bill aims to set aside the centuries-old practice of instant divorce by men.
The government had earlier even got passed the Muslim Women Protection of Rights on Marriage Bill.
While the bill was cleared by Lok Sabha last year, it is stuck for now in the upper house of the Parliament.
The provision of bail, it need be mentioned, was one of the demands of the opposition parties.
The proposed law would only be applicable on instant triple talaq or ‘talaq-e-biddat’ and it would give power to the victim to approach a magistrate seeking “subsistence allowance” for herself and minor children.
A woman can also seek the custody of her minor children from the magistrate who will take a final call on the issue.>
