Even as the opposition parties are calling for review of the Supreme Court order on the SC/ST Act and the arrest post the complaint, the Chhattisgarh police has gone ahead and issued directives to the Superintendents of Police to prevent abuse of the act.
The directive issued from ADG RK Vij states that Supreme Court order in the case of Dr Subhash Mahajan vs Maharashtra state needs to be complied with.
Under the atrocities act, the arrest of public servant can be ensured only with the permission of competent officer or Superintendent of Police.
Even with the approval, there needs to be list of reasons that have been cited for the arrest.
This would then be putforth before a Magistrate who would decide on whether arrest needs to be continued or not.
It has also been said that a DSP level officer may initiate preliminary inquiry into ascertaining if the complaint is grave or is it inspired by frivolous reasons.>
