The Supreme Court, will today hear a plea filed by the Bar Association of the National Green Tribunal challenging the validity of the NGT (Practices and Procedures) Amendment Rules, 2017. The amended rules allow even a single member bench to perform a judicial function.
The bar body said the earlier rules mandated that NGT benches must have two members to hear and decide cases. A bench, headed by Chief Justice Dipak Misra, had agreed to hear the plea and posted the matter for hearing today.
Senior advocate Mukul Rohatgi, appearing for the NGT Bar Association, said, the change in rules was unconstitutional and deserved to be struck down. The functioning of NGT, which is being headed by Acting Chairperson Justice UD Salvi, has been hampered at its head and zonal benches due to non-appointment to the posts.>
