Country’s top court on Tuesday ruled certain stringent conditions to prevent misuse of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act.
The Supreme Court ruled that there shall be no immediate arrest on any complaint filed under the law against public servants.
The ruling was delivered by a bench of Justices Adarsh Goel and U U Lalit.
The bench ruled out that the arrest of a public servant under the SC/ST Act has to be preceded by a probe by atleast an officer not below the rank of deputy superintendent.
The court also clarified that there is no bar in granting anticipatory bail in cases lodged against public servants under the SC/ST Act.>
